Sexual Misconduct Drives K-12 Large Losses

Sexual Misconduct Drives K-12 Large Losses

Jan 27, 2026, 11:10 AM

(From United Educators) Sexual misconduct continues to drive significant losses for higher education and K–12 institutions, representing about 30% of all claims costs, according to United Educators’ Large Loss Report 2026. Sixteen of 23 K–12 large losses and 17 of 41 total settlements involved sexual misconduct, most tied to allegations from a decade or more ago. Many cases emerged after states expanded the time for survivors to file civil claims. Key loss drivers include declining trust in institutions, aggressive attorney advertising, third‑party litigation funding and evolving legislation. Proactive claims management and clear communication can help support fair resolutions, according to the report.
