New Federal Laws Protect Pregnant and Nursing Workers

(from Schwartz Hannum PC) As part of the omnibus spending bill signed into law on December 29, 2022, two new federal employment laws were enacted: the Pregnant Workers Fairness Act (“PWFA”) and the Providing Urgent Maternal Protections for Nursing Mothers Act (“PUMP Act”). Both the PWFA and PUMP Act provide expanded protections for pregnant and nursing workers under federal law. Some states already have similar laws, and schools should be aware of laws at both state and federal levels. 

The PWFA requires organizations of 15 or more employees to provide reasonable accommodations to pregnant workers, in a process similar to the ADA. The PUMP Act amends the FLSA and expands employee protections under the Break Time for Nursing Mothers Act, which was passed in 2010. It expands the types of workers covered and also outlines enforcement mechanisms, which were not present in the earlier law.
