Illinois To Mandate Paid Leave for Any Reason

Apr 11, 2023, 1:46 PM

(From Venable LLP) On March 13, 2023, Illinois Governor J. B. Pritzker signed the Paid Leave for All Workers Act (the Act). Beginning January 1, 2024, the Act will require nearly all covered Illinois employers to provide its covered employees up to 40 hours of paid leave per year, to be used for any purpose. Under the Act, employers may choose between an accrual system or a front-loading system. Additionally, employers must maintain records for each employee showing (1) number of hours worked; (2) number of paid leave hours accrued and taken; and (3) remaining paid leave balance.

This makes Illinois the third state with a mandatory paid time off law, following Nevada and Maine. Illinois employers should review their current policies and procedures for compliance, according to legal experts at Venable LLP.
