UBIT: Do You Still Owe Tax as a Tax-Exempt Organization?

As a not-for-profit entity, most independent schools are exempt from income tax. However, that doesn’t mean that they’re exempt from all taxes. Certain revenue-generating activities that are not substantially related to the school’s mission may be subject to unrelated business income tax (UBIT). How does a school determine which activities fall under this purview? Tax experts will outline which factors to consider when determining if an activity produces unrelated business income. Hear common examples and exclusions of unrelated trade or business activities in schools and review filing requirements.

Learning Objective: Participants will learn how to recognize unrelated business income and understand its implications for both a school’s businesses and investment activities, as well as how to determine exclusions, modifications and exceptions to unrelated business income. Participants will learn to recognize the rules for deducting expenses in determining unrelated business taxable income as well as filing requirements.

Wendy Campos has been working in public accounting since 2000 and focuses primarily on tax-exempt organizations, including foundations (both private and public), higher education institutions, hospitals, credit unions, trade associations, and other not-for-profit organizations. Campos advises a wide variety of clients, providing compliance and consulting on unrelated business income, alternative investments, obtaining and maintaining tax-exempt status, deferred taxes, and much more. She is a certified public accountant and received her B.A. in accounting from Linfield College.

Colleen Ramires, Senior Tax Manager, Moss Adams

Colleen Ramires has been working in public accounting for over 10 years and focuses on health care providers, private and public foundations, credit unions, social services organizations, educational institutions and associations. Ramires advises a wide variety of clients, providing compliance services and consulting in areas such as unrelated business income, impacts of the Tax Cuts and Jobs Act, entity structuring, public support planning and employee compensation and benefits. She is a certified public accountant and received her B.A. in accounting from Central Washington University.

Pete Talbot, Managing Director, Research, EAB

Pete Talbot serves as the program lead for EAB’s District Leadership Forum and Independent School Executive Forum. Previously Talbot led EAB’s higher education research programs including the Enrollment Management Forum and the University Systems Forum. He also served in The Advisory Board Company’s Talent Development division, providing leadership and management training for a wide variety of constituencies at hospitals and healthcare systems. In previous roles, he served as a curriculum designer and trainer working with students and teachers from across the United States and the world. Talbot holds a bachelor’s degree in international relations from the University of Delaware.
